Short answer: Most of the work before a sign goes up is compliance, not photography. Selling a single-family home or duplex in Berkeley now requires a Home Energy Score posted in the MLS before listing, under BESO effective January 1, 2026, with a $500 non-compliance fee. Much of the inner East Bay also needs a sewer lateral certificate to close — Berkeley under its own program, and Alameda, Albany, Emeryville, Oakland, Piedmont, El Cerrito, Kensington and the Richmond Annex under EBMUD's — and Oakland adds a sidewalk certificate.
Preparation starts with compliance, not marketing
Photography runs on your schedule. Compliance runs on someone else's. A lateral test must be witnessed by an inspector, a Home Energy Score must come from a qualified assessor, and a permitted repair sits in the city's queue — Oakland's published estimates run from same day for a solar or MEP permit with no plans, to 21 days for a regular residential permit, to 80 days for new one-to-two-unit construction, in business days assuming a complete application. So: find every point-of-sale obligation for the address, start those first, run marketing alongside.
Berkeley's BESO time-of-sale energy requirement
This is the newest obligation and the one most Berkeley sellers have not heard of. Effective January 1, 2026, selling a single-family home or duplex triggers two steps under the Building Emissions Saving Ordinance (BESO).
Step 1, before listing. Obtain a Home Energy Score from a qualified assessor and post it in the MLS listing under Property Notes and in the transfer documents. It is valid five years, and non-compliance carries a $500 fee. This is a before-you-list item, not a before-you-close item.
Step 2, before the sale is finalized. Choose one of three paths.

Triplexes and fourplexes phase in January 1, 2028. Condominiums and ADUs are exempt, as are all-electric homes and first-time homebuyers in qualifying programs, with verification.
The deferral path is real, but it puts $2,500 of your proceeds into a deposit and asks the buyer to match it. That is a term in your deal — decide it before offers arrive.
Sewer lateral certificates: two different programs
Sellers in most inner East Bay cities need a lateral certificate to close, and which program governs depends on the city.

Two things to take from that. The permit-value trigger is $60,000 in Berkeley and $100,000 under EBMUD, so a remodel budget clearing one may not clear the other. And the same $4,500 deposit behaves differently: EBMUD refunds it, Berkeley forfeits it if the six months run out.
Oakland's sidewalk certification
Under OMC 12.04.380, effective July 9, 2019, an Oakland sale or title transfer requires a sidewalk compliance certificate, as do renovations over $100,000 in value. As of September 2025 the intake fee plus 14.75% was $109.01. If repairs cannot be finished before closing, a Provisional Certificate grants a 120-day extension, with up to two more. Exceptions include estate transfers, transfers between co-owners or spouses, foreclosures and ADU conversions. We found no time-of-sale energy requirement in Oakland and no sidewalk requirement in Berkeley.
The disclosure package, assembled before listing
Disclosure obligations for one-to-four residential units are statutory and cannot be waived by an "as-is" sale. We assemble the package before the listing goes live, so buyers read it before they write.
- Transfer Disclosure Statement, Civil Code § 1102 et seq. It asks separately about work done without necessary permits and work not in compliance with building codes — two distinct questions, both answered.
- Natural Hazard Disclosure, § 1103 et seq., and Mello-Roos / 1915 Act disclosure, § 1102.6b.
- Federal lead-based paint for pre-1978 housing, 42 U.S.C. § 4852d, including the Lead Warning Statement, the EPA pamphlet and a 10-day inspection period.
- Water heater bracing and smoke alarms, Health and Safety Code §§ 19211 and 13113.8(b), by written statement.
- The Seller Property Questionnaire — a C.A.R. form, not a statute, which says on its face it is not a substitute for the TDS.

What it costs is in what a 2.5% listing commission actually buys; what is worth repairing first is in which pre-sale improvements actually pay.
Timing the launch, and the delayed-marketing option
Under NAR's Multiple Listing Options for Sellers policy — Policy Statement 8.14, adopted March 25, 2025, MLS implementation deadline September 30, 2025 — Clear Cooperation was retained, not repealed. Alongside the existing Office Exclusive there is now a Delayed Marketing Exempt Listing: the seller directs a delay of public marketing through IDX and syndication, while the listing is still filed with the MLS and visible to participants. Both require seller certification.
The detail usually omitted: NAR set no duration. Each local MLS sets its own delay length, so how long you can delay depends on which MLS your listing is filed in. Ask before planning around it.
Delayed marketing solves a specific problem — work finishing late, a tenant moving out, privacy — rather than serving as a default. Days on market for the three months ending June 2026 ran from 13 in Piedmont to 20 in Oakland per Redfin. Our own listings have averaged 15 days on market by our own reporting: historical, not current, and not a prediction about any house.
